YOUNG UPDATE

As soon the State irons out a few wrinkles in it’s payroll calculation systems, the State will begin calculating the overtime owed to the Plaintiffs and sending its calculations to us in batches of 100. We will spot check those calculations and send them on to each individual Plaintiff to check the calculations as well. Once we have done so, we will indicate to the State that we have agreed to calculations, the State will reduce them to judgments, and then issue paychecks, which will be mailed to us to send to you.

Separately the State will calculate penalty pay for those Plaintiffs that retired or terminated employment with the State of Oregon, and issue those as well.

Attorney’s fees. The attorney’s fee percentage that I received this time will be the same percentage utilized last time, unless we have to track down one of over 100 missing Plaintiffs through our internet tracker. Pursuant to the initial court order on attorney’s fees for those Plaintiffs initially accepted at 15 percent, the fees will increase to the 25 percent rate if we have to find a Plaintiff.

On our web page is a list of the missing Plaintiffs. Please review it and see if you know where any of those folks can be located so that we can ensure that they get paid.

Needless to say, we cannot predict how fast this process will go and have no idea when the checks will actually arrive.
